Terms of Sale

The purchase of products on VILLARI.IT is governed by these Terms of Sale (hereinafter referred-to as the “Terms of Sale”), which all users are required to read before executing any order.

 

VENDOR

“VILLARI” and “VILLARI.IT” are registered trademarks of Villari Srl – Via C. Battisti, 12 – 36020 Solagna (VI) Italia – P.I. / C.F. 03471050249 (referred to as “VILLARI”). VILLARI is the vendor of the products that the customers can buy on SHOP.VILLARI.IT. These Terms of Sale apply only to purchase orders made on VILLARI.IT in accordance with the procedures and time-limits specified below under the “How to complete an order” section.

 

CONSUMER SALES ONLY

VILLARI offers products for sale on VILLARI.IT only to users acting as “consumers”. “Consumer” means a natural person who is acting for purposes which are outside his trade, business, craft or profession. VILLARI therefore reserves the right not to fulfil purchase orders from individuals not falling under the category of “consumers” and, in any event, any purchase orders that do not comply with these Terms of Sale.

 

WARRANTIES AND PRODUCT PRICES

VILLARI offers only original, authentic and top quality products for sale on the VILLARI.IT site. VILLARI does not sell second-hand products. In the event of any damage caused by any products, VILLARI waives any liability. VILLARI shall also not be liable in the event that the photographs of the products for sale on VILLARI.IT do not closely match reality because of the settings of the monitor, browser or any other malfunctions independent of VILLARI. All items for sale on VILLARI.IT have a label and seal, which are considered an integral part of each product. The prices of the products sold on VILLARI.IT are subject to change and may differ depending on the Country in which the product is to be shipped. With respect to deliveries outside the European Union, it may happen that some administrative burdens, such as, for example, customs duties cannot be determined in advance; in those cases, nonetheless, those administrative burdens will be borne by the customers, All users should make sure of the final price before completing the purchase order.

 

HOW TO COMPLETE A PURCHASE ORDER

To make an order on VILLARI.IT, all users must hold a valid e-mail address and meet all legal requirements necessary to enter into a purchase agreement with VILLARI.
It is possible to complete an order by following these steps:
1. 1. After selecting one or more products to buy, add them to the cart and click on Add to cart”;
2. 2. Fill out the order form and follow the instructions. The order form will clearly set out the essential features of the items ordered, their price (including all taxes and duties), delivery costs, terms of payment and delivery, a direct link to the“Returns” section where to find the procedure, timing and conditions to perform the right of withdrawal and return the items purchased.
3. 3. Before sending the order form, users are asked to read the Terms of Sale and the Information on the right of withdrawal and to print and keep a copy for personal use. The provisions included in these sections should be read carefully, jointly with the “Privacy Policyand “Terms of Sale”, both accessible via a specific link, since any user submitting a purchase order will be deemed to be fully aware and in agreement with these provisions.

5. 5. At this stage, click on “Complete Order” to submit the order form to VILLARI. Once VILLARI has received the order form, the purchase order will be complete.
6. 6. Upon receipt of the order form, VILLARI will e-mail the customer a receipt including the information already indicated in the order form (essential features of the items, price, delivery charges, mode of Payment and delivery) and will give effect to the purchase order.
7. 7. The order is stored in the database and customers can consult it at any time by logging onto their “Account” with the “Login” function.
Purchases agreements are deemed to be executed only when VILLARI communicates to customers that the items have been dispatched.
VILLARI reserves the right not to execute purchase orders that are incomplete or incorrect, or that do not provide a guarantee of creditworthiness. In these cases, customers will receive an explanatory email confirming that the order has not been accepted. VILLARI also reserves the right not to execute purchase orders where the items are unavailable, for any reason, including temporarily. In such a case, within 15 days upon order receipt VILLARI will inform the customer by e-mail that the items are not available. VILLARI reserves the right to accept purchase orders for products to be shipped only to the Countries listed in the section “DELIVERY” of the website.
If the products ordered are available and VILLARI intends to accept the purchase order, VILLARI undertakes to process the order and make the shipment of the products within 15 (fifteen) days. VILLARI is exempt from any responsibility for delays in the delivery of products that are independent by VILLARI, for example, because dependent on the service provided by the carrier which manages the delivery.

 

PAYMENTS

Users will find the different available payment types and delivery charges in the order form.
 The purchase price and delivery expense reported in the order form will be charged when the order has been completed. If the customer pays by credit card, VILLARI guarantees that the payment will be carried out via a secure payment gateway and that VILLARI will not get access to or store any financial information.

 

SHIPPING AND DELIVERY

Save the case when products are entirely or partially unavailable, VILLARI commits to make the parcel available to the courier within 15 (fifteen) days from the date of the purchase order.
Orders received are shipped and delivered by a courier chosen by VILLARI. VILLARI shall not be held liable for any delay in the delivery when independent from VILLARI, for instance because due the activity carried out by the courier in the specific case. VILLARI ship only to this countries: We ship only to these countries: ITALY, AUSTRIA, BELGIUM, FRANCE, BULGARIA, CYPRUS, CROATIA, ESTONIA, FINLAND, GERMANY, GREECE, IRELAND, LATVIA, LUXEMBOURG, MALTA, NETHERLANDS, POLAND, PORTUGAL, UNITED KINGDOM, CZECH REPUBLIC, ROMANIA, SLOVAKIA, SLOVENIA, SPAIN , SWEDEN, HUNGARY, SWITZERLAND, ALBANIA – THE FORMER YUGOSLAV REPUBLIC OF MACEDONIA, MONTENEGRO, SERBIA, BOSNIA AND HERZEGOVINA, KOSOVO.

 

RIGHT OF WITHDRAWAL

Customers have the right to withdraw from the contract entered into with VILLARI, without incurring in any penalty and without giving any reason. The term for withdrawal expires after 14 (fourteen) days from the day on which the customer acquires physical possession of the goods.
Returned items must be shipped to VILLARI without any unreasonable delay and, in any case, within 14 (fourteen) days from the date in which the customer communicated to VILLARI their intention to exercise the right of withdrawal. In this case, the customer needs to prove that dispatch/shipment of the returned items has taken place not later than the above mentioned deadline (proof of mailing). The customer always bears the direct cost of returning the items.
Customers are only liable for any diminished value of the items resulting from the handling of the goods other than what is necessary to establish the nature, char¬acteristics and functioning of the goods.
Customers must:
1. 1. Restraing from removing tags or labels from the items;
2. 2. Return intact and complete items, including any accessories;
3. 3. You may not use the products before return.
In the event that a customer does not meet either the terms to communicate the right of withdrawal and/or the term to return the items, as specified above, or any of the customer obligations, particularly those mentioned under points 1, 2 and 3 above, VILLARI will no longer be obliged to refund the purchase price to the customer.

AMENDMENTS TO THE TERMS OF SALE

VILLARI reserves the right to amend or update these Terms of Sale every time is necessary or appropriate. Users should regularly read these Terms of Sale and, in any case, read them carefully before carrying out any order.
